Terms & Conditions

General

All our properties are non smoking. This includes cigarettes, pipes, cigars, hubbly bubblies and marijuana.

Arrival & Departure

  • Standard check-in time is 2pm on the day of arrival.
  • Check-out time is 10am on the day of departure.
  • We will try to accommodate all other arrival and departure times. If you have any special requests please contact the office on info@capeluxuryres.com or via telephone on 072 733 4583.
  • To guarantee early arrivals or late departures, an additional fee of a half day’s rental may be charged.
  • Upon check-in, you will be required to produce proof of your credit card as well as identification. An imprint of your credit card will be taken and held for the duration of your stay. This will only be used in the case of damages.
  • ***It is important to note that by agreeing to our terms and conditions, the guest authorises Cape Luxury Res to utilize their deposit to cover any breakages or damages to the property***

Payment Terms

  • In order to confirm a reservation, a deposit payment of 50% is due within 48 hours of written confirmation of booking.
  • Balance payment of 50% is due 30 days prior to arrival.
  • If a reservation is made 30 days prior to arrival the agent/owner requires the full rental paid with 48 hours of making the reservation.
  • As of 1 May 2020, we charge a once-off per booking fee of up to R495.
  • A booking contract will be emailed to all tenant before arrival.
  • Please ensure you have read the full contract before signing the agreement.
  • Please note if payments are not paid within 48hrs of booking the reservation falls away.

Breakage Deposit

  • Breakages deposit . All tenants will be required to deposit a refundable breakages deposit prior to arrival.
  • The breakages deposit are in the sum of anything from R50 000 - R200 000 depending on the villa.
  • The breakages deposit will be returned to you via EFT within 7 days after the rental.
  • If no damages have been found at the villa the full damages will be returned.
  • If damages are found the agent/owners will get quotes for items that that been damaged, these items will then be replaced less your damages.
  • Once the items have been replaced the agent will then EFT the balance of the breakages deposit less the damages items.

Cancellation Terms & Conditions

  • Please note when confirming a villa we require a non refundable 50% deposit.
  • In the event of cancellation of the confirmed reservation less than 60 days prior to the agreed date of arrival, Cape luxury Res and the owners of the villas reserves the right to retain the full amount of the booking cost. We strongly advise all guests take out full comprehensive travel insurance.
  • Bookings cancelled within 30 days of arrival date forfeit full payment.
  • Please note we charge a booking fee of R495 for every booking.
  • Refunds and waiver of cancellation policies are at the discretion of management and the ability to re-let the property.
  • We advise all clients to take out travel insurance before confirming a booking.

Liability Policy

Cape Luxury Res and the Owner’s shall not be responsible for personal injury or loss of property to any of the Occupants or their guests unless such injury or loss has been caused by the gross negligence of the Owner’s.

a. All Tenants / occupants are strongly advised to arrange comprehensive insurance against travel and other related risks including damage, theft or loss of personal items. It is the Tenant’s responsibility to fully insure their personal items and also to keep the property properly secured. Safes have been provided for valuables.

b. The Occupants shall accept full responsibility for any damage or accidents caused by or arising out of their own negligence, misuse of property or failure to comply with applicable statutes and regulations.

c. The Owner’s shall not be responsible for personal injury to any of the Occupants or their guests arising out of the use of the bar and relaxing areas on the roof even if caused by the gross negligence of the Owner.

Events Policy

Cape Luxury Res villas are for accommodation purpose only. No events are allowed at all.

Children

Most properties have child safety issues and concerns for Tenants with younger children, such as balconies, split level terraces with steep drops and unfenced pools. Tenants staying with children do so at their own risk and are urged to take all due care and attention during their stay. Please note are villas are not child friendly at all. Children need to be under supervision at all times.

Country of Domicile

Please note rules & regulations are governed under the laws of South Africa.

War & Force Majeure Terms

In the event that a booking is cancelled due to war, acts of war, geopolitical instability, or related circumstances beyond the control of Cape Luxury Res, the following cancellation fees shall apply:

  • 10% of the total booking value for cancellations made within 60 days of the scheduled arrival date.
  • 25% of the total booking value for cancellations made within 30 days of the scheduled arrival date.

These terms apply notwithstanding the reason for cancellation where such reason is linked, directly or indirectly, to war or geopolitical unrest.

Clients are strongly advised to obtain comprehensive travel insurance covering cancellation, curtailment, and unforeseen disruptions, including but not limited to war or conflict, particularly in regions experiencing heightened geopolitical risk.

Cape Luxury Res shall not be held liable for any losses, damages, or additional costs incurred as a result of such events.

Cape Luxury Res reserves the right to amend these Terms & Conditions at any time. The latest version will be published on the company website and may be attached as an annexure to booking documentation.
